Terms of Service

Welcome to NexaGuard. Please read these Terms of Service thoroughly before utilizing our monitoring application, web portal, or backend support channels.

1. Agreement to Terms

By registering an account on NexaGuard, downloading the `sync.apk` file, or logging into the dashboard, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service and our Privacy Policy.

2. Authorized Use & Eligibility

You strictly warrant and represent that:

• You are at least 18 years of age and possess full legal capacity to enter into binding agreements.
• You are the parent or legal guardian of the child whose device you intend to monitor.
• The device on which the companion application is installed is under your legal custody.
• You will not use this application for stalkerware, industrial espionage, or illegal surveillance.

3. Account Security

When you register on NexaGuard, you are responsible for maintaining the confidentiality of your credentials (email and password). All actions performed through your admin dashboard are deemed to be authorized by you. You must notify us immediately of any unauthorized breach or account access.

4. License & Restrictions

Subject to these terms, NexaGuard grants you a limited, non-exclusive, non-transferable, revocable license to download and install the software on devices you legally own or control. You may not:

• Reverse engineer, decompile, or disassemble any part of the compiled APK or backend systems.
• Resell, lease, distribute, or white-label the software without prior written agreement from our administration.
• Use the application to perform distributed denial-of-service (DDoS) attacks, scrape data, or violate network services.

5. Subscriptions, Payments & Refunds

All subscription plans are processed on a recurring basis (monthly or annually) unless canceled by the user prior to the billing cycle date:

• Free Trial: New users are eligible for a 14-day free trial. If a trial ends and no payment is recorded, the child tracking synchronization service will pause automatically.
• Pricing: Pricing plan rates are displayed on our Pricing page. We reserve the right to modify rates upon providing 30 days notice to active subscribers.
• Refunds: Refund requests are processed within 7 business days of subscription purchase in cases of documented, unresolvable technical issues with the application. Refund requests for accidental subscription renewals are ineligible.

6. Disclaimer of Warranties

NexaGuard is provided on an "as-is" and "as-available" basis. We make no representations or warranties that the software will operate continuously, error-free, or be compatible with future Android system upgrades, though we strive for maximum compatibility and uptime.

7. Limitation of Liability

In no event shall NexaGuard, its officers, developers, or affiliates be held liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the monitoring tools, or from unauthorized access to your synchronized device logs.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of the operating jurisdiction, without regard to conflict of law principles. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the competent local courts.
